1. Introduction and Acceptance

Welcome to FiziArt Studio. These Terms of Service govern your use of our website at fiziart.studio and your engagement with our handmade art services, including custom commissions, ready-made artwork purchases, and all related inquiries.

FiziArt Studio is a handmade art studio based in Pakistan, founded and operated by a single artist specializing in:

• Arabic and Urdu calligraphy
• Persian illumination with gold leaf
• Custom Nikah Nama (Islamic marriage certificate) designs
• Handpainted landscape art
• Custom bespoke artwork and gift collections

By accessing our website or placing an order or inquiry with us, you agree to be bound by these Terms of Service in full. If you do not agree with any part of these terms, please do not use our website or engage our services.

2. The Nature of Our Services

2.1 Entirely Handmade Artwork

Every piece created by FiziArt Studio is made entirely by hand. We do not use digital design software, printers, plotters, or any form of machine assistance in the creation of our artwork. Each piece is unique, created using traditional techniques including:

• Hand-lettered calligraphy using traditional Qalam, brush, and fine nibs
• Hand-painted Persian illumination using mineral pigments and 24K gold leaf
• Handpainted landscapes using acrylics, oils, gouache, and watercolours on canvas, paper, and Vaasli
• Handcrafted Nikah Nama certificates combining calligraphy and illumination

Because our work is entirely handmade, minor natural variations in color, line weight, and texture from any preview or reference image are an inherent and valued part of the artwork — not a defect.

2.2 Custom Commissions

A significant portion of our work consists of custom commissions created specifically according to each client's individual requirements. Custom commissions include but are not limited to personalized calligraphy pieces, Nikah Nama designs with specific names and dates, and custom-size artwork.

2.3 Ready-Made Artwork

We also offer a selection of completed, ready-made artwork available for immediate purchase through our website shop or WhatsApp.

3. Placing an Order or Commission

3.1 Inquiry and Consultation

To place a custom commission, clients must first contact us via our website contact form, WhatsApp, or email. We will personally respond to every inquiry within 24 hours during studio hours (Monday to Saturday, 9:00 AM to 8:00 PM Pakistan Standard Time).

3.2 Commission Confirmation

A commission is considered confirmed only after:

1. All artwork details have been mutually agreed upon in writing (via WhatsApp or email), including script style, size, text content, color palette, medium, and any special requirements
2. A deposit or full payment has been received and confirmed by FiziArt Studio

We reserve the right to decline any commission at our sole discretion without obligation to provide a reason.

3.3 Your Responsibility for Accuracy

It is your sole responsibility to ensure that all information provided for a custom commission — including names, dates, Quranic verses, poetry, or other text — is accurate and correctly spelled before work begins. FiziArt Studio will create the artwork exactly as specified and confirmed. We are not responsible for errors in information provided by the client.

For Nikah Nama commissions specifically, please double-check all names, dates, and personal details carefully before confirming your order.

3.4 Layout Preview

For custom commissions, we provide a layout sketch or digital preview for your approval before we begin the final artwork. Work on the final piece begins only after you have reviewed and approved the layout in writing.

4. Pricing and Payment

4.1 Pricing

All prices are quoted in Pakistani Rupees (PKR) unless otherwise agreed. Prices for custom commissions are provided on a per-project basis following discussion of your requirements. Ready-made artwork prices are as listed on our website.

Prices are subject to change without prior notice for new inquiries. Any price quoted and agreed upon for an active commission will not change after confirmation.

4.2 Payment Terms

• A non-refundable deposit of 50% of the total agreed price is required before any work begins on a custom commission
• The remaining 50% balance is due upon completion of the artwork and before delivery or shipping
• For ready-made artwork, full payment is required before dispatch
• Payment methods accepted include bank transfer, EasyPaisa, JazzCash, and other methods as agreed at the time of order

4.3 Currency and International Payments

For international orders, pricing may be agreed in USD or GBP. Any bank charges, transfer fees, or currency conversion costs are the responsibility of the client.

5. Production Timelines and Delivery

5.1 Estimated Timelines

All timelines are estimates based on current workload and the complexity of your commission. Typical estimated timelines are:

• Arabic and Urdu calligraphy pieces: 7 to 14 working days
• Persian illumination artwork: 14 to 21 working days
• Nikah Nama designs: 10 to 15 working days
• Landscape paintings: 7 to 14 working days
• Custom bespoke artwork: Timeline provided individually based on complexity
• Ready-made artwork: Dispatched within 3 to 5 working days

All timelines begin from the date of deposit payment and layout approval, not from the date of inquiry.

5.2 Timeline Variations

Handmade art requires patience and focused attention. We never rush our work and will not compromise quality for speed. If your commission requires additional time, we will notify you promptly. We kindly ask clients to respect the handmade nature of our process when considering timelines.

For time-sensitive occasions such as weddings, we strongly recommend placing your Nikah Nama order at least 4 to 6 weeks before the event date to allow sufficient time for creation, revision, and delivery.

5.3 Delivery and Shipping

• Domestic delivery within Pakistan is available via tracked courier services
• International delivery is available worldwide via tracked international courier
• All shipping costs are the responsibility of the client and will be agreed upon before dispatch
• FiziArt Studio is not responsible for customs duties, import taxes, or delays caused by customs procedures in the destination country
• All artwork is carefully packaged in protective materials to ensure safe delivery
• A certificate of authenticity confirming the piece is 100% handmade by FiziArt Studio is included with every commission and ready-made purchase
• Once an order has been dispatched and tracking information has been provided, FiziArt Studio is not responsible for delays, losses, or damage caused by courier services

6. Revisions and Changes

6.1 Pre-Production Changes

Changes to commission details (text, size, style, color) can be made at no additional charge before the layout has been approved and final work has begun.

6.2 Post-Approval Changes

Once you have approved the layout and final production has begun, changes to the commission specifications may not be possible or may incur additional charges depending on the nature and extent of the change. We will always discuss this with you before proceeding.

6.3 Revisions to Layout Preview

We offer up to two rounds of revisions to the layout preview at no additional charge. Additional revision rounds beyond this may be subject to a small fee.

7. Cancellations and Refunds

7.1 Custom Commissions

Because every custom commission is created specifically for you and cannot be resold, the following cancellation policy applies:

• Cancellation before layout approval: The deposit paid will be refunded minus any administrative costs incurred
• Cancellation after layout approval but before production begins: 25% of the total commission value will be retained to cover design work; the remainder of any amount paid will be refunded
• Cancellation after production has begun: No refund will be issued as the handmade work is already underway and materials have been used
• Cancellation after completion: No refund will be issued

7.2 Ready-Made Artwork

Ready-made artwork purchases are non-refundable once dispatched, as these are original handmade pieces.

7.3 Damaged or Incorrect Artwork

In the rare event that your artwork arrives damaged due to shipping, please photograph the damage immediately upon receipt and contact us within 48 hours of delivery. We will assess the situation and discuss an appropriate resolution, which may include reproduction of the piece at a reduced cost.

If we have made a genuine error in executing your commission that significantly differs from the approved layout, please contact us within 48 hours of receipt and we will work to resolve the matter fairly.

7.4 Refund Processing

Any approved refunds will be processed within 10 to 14 working days via the same payment method used for the original transaction.

8. Intellectual Property Rights

8.1 Ownership of Artwork

FiziArt Studio retains full intellectual property rights and copyright in all artwork we create, including custom commissions. The sale or delivery of an artwork transfers physical ownership of the piece to the client but does not transfer copyright or intellectual property rights.

8.2 Portfolio and Promotional Use

FiziArt Studio reserves the right to photograph, display, and share images of any completed artwork — including custom commissions — on our website, Instagram, portfolio, and other promotional materials, unless the client expressly requests confidentiality in writing at the time of placing the order.

8.3 Client's Personal Use

You may photograph and share your commissioned or purchased artwork on your personal social media accounts. We kindly request that you credit @fiziartstudio when sharing your piece online.

8.4 Reproduction Prohibited

You may not reproduce, copy, print, sell, distribute, or commercially exploit any artwork created by FiziArt Studio without our prior written consent. Unauthorized reproduction of our artwork constitutes copyright infringement.

8.5 Website Content

All content on our website — including artwork images, photographs, written content, design, and branding — is the intellectual property of FiziArt Studio and is protected by copyright. You may not reproduce or use any content from our website without prior written permission.

9. Website Use

9.1 Acceptable Use

You may use our website for lawful purposes only. You agree not to:

• Use the website in any way that violates applicable local, national, or international laws or regulations
• Transmit any unsolicited or unauthorized advertising or promotional material
• Attempt to gain unauthorized access to any part of our website or its systems
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website

9.2 Website Availability

We aim to keep our website available at all times but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the website at any time without prior notice.

9.3 Accuracy of Information

We make every effort to ensure that the information on our website is accurate and up to date. However, artwork images on screen may vary slightly from the actual finished piece due to monitor calibration, photography lighting, and the natural characteristics of handmade materials. We are not liable for any discrepancies between screen representations and the physical artwork.

10. Limitation of Liability

To the fullest extent permitted by applicable law, FiziArt Studio shall not be liable for:

• Any indirect, incidental, special, or consequential loss or damage arising from your use of our website or services
• Loss of data, loss of revenue, or loss of profit arising in any circumstances
• Delays in production or delivery caused by circumstances beyond our reasonable control, including natural disasters, power outages, illness, or courier failures
• Damage to artwork caused by couriers or postal services after dispatch
• Customs delays or import restrictions in the client's country

Our total liability to you in connection with any commission or purchase shall not exceed the total amount paid by you for that specific commission or purchase.

11. Governing Law and Disputes

These Terms of Service are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising in connection with these terms or our services shall first be addressed through good-faith direct communication between both parties.

If a resolution cannot be reached through direct communication, disputes shall be subject to the jurisdiction of the courts of Pakistan.

12. Privacy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. Please read our Privacy Policy carefully to understand how we collect, use, and protect your personal information.

13. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services following any changes constitutes your acceptance of the revised terms.
